The basic idea is OK; as you said though I'm not sure of the legal
implications as the penguin is universally associated with the Linux
kernel.

Taking the bird idea further, looking at this Wikipedia image I see a
couple of birds that might be appropriate but I have no idea if they are
already taken:

Birds that imply lightweight operation and speed, such as the hummingbird
or various members of the swallow family would be my first choices.  In
line with TDE's professional image (at least that's what I aspire for TDE
to be...) something that could be used and easily recognized in
businesslike vector art  (e.g. for logos and such) would also be
preferred.
